Guinness PRO12 Fantasy Rugby 2016-17 - Terms and Conditions

The following Terms and Conditions constitute an agreement between the Entrants, the Game Operator and the Publisher.

It is important that Entrants read them carefully and understand what they mean. By entering into the Game, Entrants confirm their complete understanding and acceptance of these Terms and Conditions.

Definitions

In these Terms and Conditions:

Game means Guinness PRO12 Fantasy Rugby 2016-17. The Game will run on the Website and/or in other partner publications as deemed appropriate by the Publisher from time to time.

Game Judges means the Publisher and Game Operator, and any employees or agents who are specifically designated to make a decision in terms hereof and as it relates to the Game. In this regard the Entrant agrees to abide strictly by such decision.

Game Operator means GFM Clevergames Limited, a company registered in England and Wales number 09150260 and registered address 42 Phoenix Court Hawkins Road, Colchester, Essex, CO2 8JY.

Materials means the text, graphics, photographs, pictures, sounds, digital audio and video clips published on the Websites to publicise the Game.

Players means real life rugby players.

Publisher means PRO12 Rugby Limited, a company registered in the United Kingdom under company registration number XXXXXX, with its registered address at XXXXXX.

Entrant/Entrants means Entrants of the Websites who make an entry into the Game.

Websites means the following websites:

1. Eligibility

1.1 Minimum Age

Entrants must be 18 years of age to play the game. Failure to observe this will deem any winning entry invalid and prizes will be forfeited.

1.2 Territory

The Game is intended for play within the United Kingdom, Ireland, Italy and France and is governed by English law. Each entrant must ensure that his or her participation in the Game is lawful in accordance with the laws of the country of which he or she is a citizen and/or resides, and/or happens to be at the time his or her entry is made. Neither the Game Operator nor its servants or agents or the Publisher shall be taken to make any representations, express or implied, as to the lawfulness of any entrant's participation.

1.3 Eligibility

Employees of the Publisher, the Game Operator, their respective group companies, agents, and members of their families or households may enter but will NOT be eligible to win or receive prizes.

2. The Game

2.1 Duration

The Guinness PRO12 Fantasy Rugby 2016-17 competition will run from September 2nd 2016 until the final round of PRO12 fixtures on May 27th 2016.

2.2 Entry

Go to fantasy.pro12rugby.com and follow the onscreen instructions. Entrants' entries are free of charge. Entries (and any subsequent changes i.e. transfers) must be made manually by the Entrant via the online form available on the website. Any use of automated processes to take part in this competition is forbidden, and any Entrant suspected of using automated processes may have their teams deleted. This is at the discretion of the Game Operator, and the decision of the Game Operator is final.

Entries can be made at any time during the tournament until May 27th 2016, but to score for the first round of matches on September 2nd 2016, entries must be completed by the earliest scheduled kick-off on that day. Entries received up to the earliest kick-off each day will score from that day onwards. Entries received after earliest kick-off each day will begin scoring from the next round. No Player points will be backdated.

2.3 Teams

The Game is limited to one team per entrant. The Game Operator reserves the right to reject any team/entry name that it considers to be inappropriate or offensive. In such an event, the Game Operator will automatically apply another team name. The Game computer's record of an entry will be regarded as the entry itself. The Game Operator and the Publisher will not be held responsible for entries lost or distorted in transfer. Proof of magnetic transcript is not accepted as proof of entry.

2.4 Eligible Matches

Eligible matches are all games in the Guinness PRO12 season. Eligible matches are subject to change.

2.5 Notifications

By registering to play the Game you are agreeing to receive in-game e-mail updates. You can unsubscribe from these e-mail updates by following the unsubscribe instructions within the e-mail. The Publisher may from time to time offer Entrants discounts and special promotions at its sole discretion. To qualify for discounts and special promotions online Entrants must comply with the offer conditions.

2.6 Final Decision

If the Game Judges believe at any time that, in their sole opinion, a single Entrant has made more than one registration for a team then we reserve the right to remove all, or some, of those entrants and entries from the Game or make them ineligible for prizes. The Games Judges' decision regarding the exclusion of teams will be final and no correspondence relating to such exclusions will be entered into.

3. Picking Your Team

3.1 Team Selection

Entrants may only select one team for the competition - multiple teams will be deleted.

Entrants may select a maximum of three Players from any one club during the Guinness PRO12 season.

3.2 Player Selection List

Only Players included in the official Game selection list may be included in a team and a Player cannot appear in the same team more than once. Player values are arbitrarily allocated for the purpose of the Game and the Game Operator will not enter into any correspondence regarding Player valuations.

3.3 Formations

Only the positions allocated to Players in the official Game selection list will apply to the Game and the Game Operator will not enter into any correspondence regarding Playing positions allocated for the purpose of the Game. Each team entered into the Game must consist of 15 Players. The 15 playing positions must be selected in the following formation:

  • 3 x Front-row forwards
  • 2 x Second-row forwards
  • 3 x Back-row forwards
  • 1 x Scrum-half
  • 1 x Fly-half
  • 2 x Centres
  • 3 x Outside backs

Alternatively, Entrants may choose to utilise the 'Auto Select' feature in which case the Game computer will randomly select an eligible team which will be shown on the screen.

3.4 Budget

Entrants must pick an initial team of 15 Players; the total value of the team must not exceed £100m, although there is no obligation to use the full budget.

4. Scoring Points in the Game

4.1 Points

Based on their performance, Players will be allocated points score after each game. Actions occurring in extra time count but penalty shoot-outs do not. Points are awarded as detailed in the table below:

The Man of the Match bonus points are awarded in line with the PRO12 Rugby's official decision.

Neither the Game Producer nor the Publisher will enter into any correspondence relating to the allocation of points to Players. We accept no responsibility for the accuracy of this data.

4.2 Assists

The player providing the 'last pass' before a try is scored is awarded three points for an assist. This can only be in the form of a thrown pass or a kick by a member of the same team, which reaches the try scorer without significant intervention from a member of the opposing team. No assist will be awarded for a pushover try directly from a scrum, or indeed any situation where there is not an obvious 'last pass'. Hence, there is also no assist if the try scorer picks up the ball from the ground or directly from the hands of a team-mate. An assist will only be awarded for a penalty try if a try is prevented due to an offence on an individual player to prevent a try, in which case the player fouled will gain the assist. In all cases, the decision of PRO12 Rugby and the Promoter is final.

4.3 Deadlines

The round deadlines are detailed on the Rules and FAQs page. These dates are subject to change depending on the fixture schedule.

Any transfers or Kicker changes made after the deadline will become active at the next deadline.

Teams entered after the round deadline will not score points for that round.

4.4 Kicker

Entrants must nominate a member of their team to be Kicker. This Player will be the only player in the team who will score points for penalties and conversions. If the Kicker does not play then the bonus will be lost. Another Player will not take over the Kicker role in their place.

4.5 Transfers

The Publisher and Game Operator will not be responsible for transfers lost in transmission or submitted late whether due to high online traffic or not. In addition to the transfer allocation, Entrants may make unlimited transfers during the pre-season transfer amnesty. This will apply from 00:01 Thursday 18 August 2016 until the scheduled kick off of the first eligible match. These dates are liable to change based on fixture rescheduling.

Transfers can be made online only at the official Guinness PRO12 Fantasy Rugby website and the mobile site. Entrants may use the transfers page to change their team for the next round. Entrant may make 2 free transfers per round in the regular season.

If an Entrant does not use their full allocation of transfers for a single round, then unused transfers are not carried over to the following round.

5. Leagues

5.1 Leagues

Each Entrant competes and is automatically entered in a number of leagues. These are:

  1. The Overall League
  2. Monthly Prize League
  3. A league for supporters of your favourite team
  4. Private leagues with your friends and colleagues. Private leagues are joined at the Entrants discretion and are not compulsory.

Entrants can choose to either create their own Private leagues to compete with friends and colleagues, or join an existing Private league.

In all leagues teams are ranked based on the total points in the game.

6. Prizes

6.1 Prizes Page

Entrants shall compete for prizes based on the performance of their Team. Full breakdowns of the prizes on offer are listed on the Prizes page.

6.2 Overall Winners

The overall winner will be the Entrant who accumulates the most points over the matches played during the Guinness PRO12 season. The prize will be awarded to the Entrant whose team has amassed the highest number of points in the Overall league after all the matches within the Game are complete.

6.3 Monthly Winners

The monthly winner will be the Entrant who accumulates the most points over the matches played during each month. The prize will be awarded to the Entrant whose team has amassed the highest number of points after all the matches within the calendar month are complete.

6.4 Tiebreak

Teams are ranked based on the total points in the game. In the event of a tie between teams, the team which has registered the most goals during the competition will be positioned higher. If a tie remains, the team which has registered the most assists during the competition will be positioned higher, followed my most clean sheets registered. In the unlikely event that teams remain tied at this stage, the team that was entered in the competition first will be named the winner. 7. General

7.1 Notification of Winnings

Winners will be notified via e-mail and prizes sent out within 28 days of the prize being verified by the Game Judges. If the Game Judges have been unable to contact the winner of any prize within 14 days of that game period or competition ending, the prize will be awarded to another Entrant. In cases where the Entrant in first place has not responded within 14 days, the prize will be awarded to the Entrant of the next highest scoring eligible team in that game period or competition. Winner's names may also appear on the Game Website the day after each prize period is completed. The decision of the Game Judges will be final in all matters relating to the awarding of Game prizes and no correspondence will be entered into and of the league and will not be made payable to any other person under any circumstance.

7.2 Data

By entering this promotion, any Entrant over the age of 18 agrees that the Publisher may use your information to contact you about products and services you may like. You can change your direct marketing preferences by unsubscribing from these e-mail updates by following the unsubscribe instructions within the e-mails. Any Entrants under the age of 18 will not have their data shared with any third party for marketing purposes.

8. Miscellaneous

8.1 No Liability

The Game Operator and the Publisher have made all reasonable endeavours to ensure that the Game is provided using reasonable skill and care. However, no warranties are made whatsoever in relation to the accuracy, suitability, reliability, completeness or otherwise of the Game itself nor in relation to disruptions, delays or errors in connection with the Websites or the internet, in particular for any acts or omissions made by any telecommunications service provider with whom you have contracted to gain access to the Websites, all to which without limitation the Game Operator and the Publisher accepts shall not be held responsible. Further, no warranty is made in respect of information to which you may have access but which has not been directly provided by the Game Operator and/or the Publisher, including without limitation, information on the internet available outside of the Websites which shall remain the responsibility of the provider of such information.

8.2 Limitation of Liability

Except as expressly provided in these Terms and Conditions, and to the extent permitted by law, the Publisher, its employees, agents and partners disclaim any and all liability in respect of any loss or damage arising out of the Game and/or Websites, whether such loss or damage results from negligence, breach of statutory duty or otherwise, and whether in contract or in tort or otherwise, including but not limited to the loss or corruption of data, any errors or omissions, content, delays or interruptions in transmission or operation and lines or communication failure. In no event shall the Game Operator and the Publisher be liable for any loss of profit, goodwill and any indirect, special or other consequential or incidental damage, whether foreseeable or not. In the event that any liability does arise then the liability of the Publisher and/or the Game Operator whether in contract, tort or at law shall be limited in aggregate to the money paid by the relevant Entrant in lieu of registration to play the Game.

8.3 Intellectual Property

Without limitation, all of the Game Materials and content on the Websites is the exclusive property of the Publisher and/or of the companies who may have supplied such Materials to the Publisher. The Material, including compilation, selection, presentation and arrangement thereof, is protected by national laws and international agreements on copyright, moral rights and other intellectual property rights. All promotional and explanatory material on the Websites form part of the Terms and Conditions. Entrants may not modify, reproduce, distribute exchange, sell or transmit any of the Material, nor store it in any form (whether tangible or electronic). Copying or downloading the Material for any business, commercial or public purpose is strictly forbidden. Civil or criminal liability may result from any use in contravention of this clause. The Game's name and logo, and any other graphics, logos and trademarks used on the Websites are protected by laws and international agreements on intellectual property. None of the trademarks may be used in association with the products or services of a third party or in a manner which could, either directly or indirectly, defame or discredit us or a third party. All trademarks and trade names appearing on the Website (including names or products belonging to third parties) remain entirely the intellectual property of the Game Operator or the Publisher or the intellectual property of their respective owners (as the case may be).

8.4 Changes in Terms and Conditions

The Game Operator and the Publisher reserve the right, at both parties sole and absolute discretion, to rule on any unforeseen circumstances or circumstances beyond our control in whatever way the Game Operator and/or the Publisher deem most appropriate (including the cancellation or postponement of the Game or changes to these Terms and Conditions) in order to reach what either party considers to be an equitable solution for the Entrants to the Game. The Game Operator and/or the Publisher's decision will be announced on the Website as soon as reasonably practicable after such decision has been reached. No correspondence will be entered into by the Game Operator or the Publisher in respect of such decision which will be final and binding in all respects.

8.5 Force Majeure

Neither the Game Operator nor The Publisher shall be liable for its failure fully to perform their obligations under this Agreement if and to the extent that such failure is due to reasons of force majeure or change in laws or regulations or any other occurrence beyond either party's reasonable control.

8.6 Prizes

All prizes are underwritten by the Publisher.

8.7 Governing Law

Terms and Conditions relating to the Game and how it's played, managed and prizes awarded shall be governed by and interpreted in accordance with English law and Entrants hereby submit to the exclusive jurisdiction of the English courts in connection with any dispute that may arise regarding any aspect of the Game or the Terms and Conditions.
